Cops: New Cassel man violated order of protection

Police said a former boyfriend who violated an order of protection and attacked a Westbury woman outside her home Tuesday was arrested Thursday.

Marcus Swain, 31, of Grand Street, New Cassel, was charged with second degree kidnapping, first degree criminal sexual act and first degree criminal contempt.

Police gave the following account: Swain grabbed his former girlfriend, 23, from behind as she was arriving home shortly after midnight, police said, carried her across the street and attempted to force her into his car. During the attack, Swain choked her, verbally threatened her, and coerced her into performing a sexual act, police said.

Swain demanded money from her, police said, but when she was allowed to go into her home to get it, she locked the door and called police.

Swain fled before police arrived, but was located at his home Thursday and arrested by Nassau police.

He is to be arraigned Friday in First District Court, Hempstead.
